By accessing, browsing, or using Selyne ("Service"), including any subdomains, mobile applications, APIs, or related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you disagree with any part of these terms, you are prohibited from using or accessing the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Selyne is an AI-powered companion service that provides:

Personalized conversations through text and voice
Growth insights and recommendations
Goal tracking and progress monitoring
Cultural content recommendations

Wellbeing analytics and reporting

The Service is intended solely for personal development and wellness support. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, OR THERAPEUTIC SERVICES. The Service is provided "AS IS" and we make no warranties about its suitability for any particular purpose.

3. Third-Party Services & Data Processing

🚨 MANDATORY CONSENT: Third-Party Data Processing

BY USING SELYNE, YOU EXPLICITLY AND IRREVOCABLY CONSENT to your data being processed by third-party AI providers and analytics services as detailed below. This consent is MANDATORY and REQUIRED for the Service to function. If you do not agree to third-party data processing, DO NOT USE THE SERVICE.

AI Service Providers

To provide intelligent conversation and voice capabilities, Selyne integrates with and shares your data with:

Anthropic (Claude AI): Your conversation content and context are processed to generate intelligent responses
Google Gemini AI: Your conversations and behavioral patterns are analyzed for personalization
xAI Grok: Your queries and conversation context are processed for real-time information integration
ElevenLabs: Your voice recordings and audio preferences are processed for voice synthesis

Each provider may store and process your data according to their own terms and privacy policies. YOU ACKNOWLEDGE AND AGREE THAT SELYNE CANNOT AND DOES NOT CONTROL how these third parties process your data beyond our contractual agreements, and SELYNE DISCLAIMS ALL LIABILITY for third-party data processing.

Analytics & Tracking Services

To improve our Service and understand user behavior, we use:

Google Analytics: Tracks website usage, page views, and user interactions
Pendo: Records app interactions, session data, and may include screen recordings

International Data Transfers

BY USING SELYNE, YOU CONSENT to your data being transferred to and processed in the United States, European Union, and other countries where our service providers operate, including countries that may not have equivalent data protection laws to your jurisdiction. YOU WAIVE ANY OBJECTIONS to such international transfers.

Service Dependencies & Limitations

Selyne's core functionality depends entirely on these third-party services. If you do not consent to third-party data processing, the Service will be unusable. NO REFUNDS will be provided for accounts terminated due to withdrawal of consent for third-party processing.

4. User Accounts & Eligibility

Account Registration & Responsibilities

To use certain features of the Service, you must register for an account. You represent and warrant that you will:

Provide accurate, current, and complete information during registration
Maintain and promptly update your information to keep it accurate and complete
Keep your password secure and confidential at all times
Be solely responsible for all activities that occur under your account
Notify us immediately of any unauthorized access or security breach
Not share your account credentials with any third party
Not create multiple accounts or use automated means to create accounts

YOU ARE FULLY LIABLE for all activities conducted through your account, whether authorized by you or not.

Age Requirements & Restrictions

You must be at least 18 years old to use Selyne. If you are between 13-18 years old, you may use the Service only with the explicit involvement and ongoing consent of a parent or legal guardian, who must agree to these Terms on your behalf and remain liable for your use of the Service. Users under 13 are strictly prohibited from using the Service under any circumstances.

BY USING THE SERVICE, YOU REPRESENT AND WARRANT that you meet these age requirements and have the legal capacity to enter into these Terms.

5. Acceptable Use Policy

You agree to use Selyne responsibly and in strict accordance with these guidelines. Violation of any provision may result in immediate termination of your access without notice or refund.

Permitted Uses

Personal development and growth conversations for lawful purposes only
Goal setting and progress tracking for personal use
Seeking general emotional support and guidance (not professional therapy)
Participating constructively in community discussions
Accessing recommended cultural content for personal enjoyment

Strictly Prohibited Uses

You are expressly prohibited from using the Service for any of the following purposes:

Any violent, harmful, illegal, or criminal content or activities
Harassment, abuse, threats, stalking, or intimidation of any person
Spam, commercial solicitation, MLM schemes, or unauthorized advertising
Impersonation of any person, entity, or misrepresentation of your identity
Attempting to exploit, reverse engineer, or harm the AI system or platform infrastructure
Sharing others' personal, confidential, or proprietary information without explicit consent
Using the Service during emergency medical, psychological, or psychiatric crises
Circumventing any security measures, access controls, or usage limitations
Creating fake accounts, bot accounts, or using automated tools to access the Service
Collecting or harvesting data from other users or the platform
Interfering with or disrupting the Service or servers/networks connected to the Service
Uploading malicious code, viruses, or any harmful computer code
Using the Service to compete with or build competing products or services
Violating any applicable local, state, national, or international law or regulation

⚠️ Enforcement & Consequences

Violation of these usage policies may result in immediate account suspension or termination, forfeiture of any paid subscriptions without refund, legal action, and reporting to law enforcement where applicable. We reserve the right to take any action we deem appropriate to address violations.

6. Payments, Subscriptions & Refund Policy

Subscription Plans & Pricing

Selyne offers both free and paid subscription plans. Paid subscriptions provide access to additional features and enhanced functionality. Current pricing and plan details are available on our pricing page and may be updated at our sole discretion.

Billing, Payments & Automatic Renewal

ALL subscriptions automatically renew unless cancelled before the renewal date
Payment is due immediately at the beginning of each billing cycle
ALL FEES ARE FINAL AND NON-REFUNDABLE except as expressly stated or required by law
We may change pricing with 30 days' notice to existing subscribers
Failed payments may result in immediate service suspension without notice
You are responsible for all taxes, fees, and charges associated with your subscription
Currency exchange fees and payment processing fees are your responsibility

Strict No-Refund Policy

🚨 NO REFUNDS POLICY

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. We do not provide refunds, credits, or prorated billing for any reason, including but not limited to:

Dissatisfaction with the Service
Account termination for violations
Technical issues or service interruptions
Changes to features or functionality
Failure to use the Service during the subscription period
Third-party service limitations or failures

Cancellation Policy

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the subscription expires, but NO REFUNDS will be provided for unused portions of the subscription period.

7. Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Selyne, you expressly consent to all practices described in our Privacy Policy.

Critical Disclaimer: While Selyne provides emotional support and guidance, all conversations are with an AI system, not human professionals. If you are experiencing a mental health crisis or emergency, immediately contact emergency services or a qualified mental health professional. DO NOT rely on Selyne for crisis intervention or emergency support.

8. Intellectual Property Rights

Our Proprietary Rights

The Service and ALL original content, features, functionality, AI models, algorithms, software, designs, graphics, logos, and trademarks are exclusively owned by Selyne and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge that the Service contains proprietary information and materials that are valuable trade secrets.

Limited License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use. This license does not permit you to: (a) resell or transfer the Service; (b) modify, reverse engineer, or create derivative works; (c) use the Service to develop competing products; or (d) extract data or content.

Your Content & Our Rights

You retain ownership of content you create or share through the Service. However, by using Selyne, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, process, store, and analyze your interactions to: (a) provide and improve the Service; (b) develop and train AI models; (c) generate insights and recommendations; and (d) ensure platform security and compliance.

You represent and warrant that you own or have sufficient rights to grant this license and that your content does not violate any third-party rights.

9. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SELYNE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Specifically, we make no warranties that:

The Service will meet your specific requirements or expectations
The Service will be uninterrupted, timely, secure, or error-free
Any results or information obtained will be accurate, reliable, or complete
Any defects in the Service will be corrected
The Service will be compatible with your hardware or software
Any AI-generated content will be accurate, appropriate, or suitable for your needs
Third-party services will function properly or remain available

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SELYNE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any case, Selyne's total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) shall not exceed the greater of: (a) $100 USD; or (b) the amount you paid to Selyne in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Selyne, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:

Your use or misuse of the Service
Your violation of these Terms or any applicable law
Your violation of any third-party rights, including intellectual property rights
Any content you submit, post, or transmit through the Service
Any harm caused to third parties through your use of the Service
Any unauthorized access to your account due to your negligence
Your breach of any representation or warranty made in these Terms

This indemnification obligation shall survive termination of these Terms and your use of the Service.

12. Force Majeure

Selyne shall not be liable for any failure to perform its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, epidemic or pandemic conditions, labor strikes, internet outages, third-party service failures, or any other force majeure events. In such cases, our performance shall be suspended for the duration of such circumstances, and we shall not be liable for any resulting delays or failures.

13. Termination Rights

Our Termination Rights

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

Violation of these Terms or our policies
Suspected fraudulent, abusive, or illegal activity
Non-payment of fees when due
Behavior harmful to other users, us, or third parties
Extended inactivity of your account
Technical or security concerns
Business reasons, including discontinuation of the Service
Any reason we deem appropriate in our sole discretion

Effects of Termination

Upon termination: (a) your right to use the Service will cease immediately; (b) you will lose access to all Service features and content; (c) we may delete your account and data without notice; (d) you remain liable for all fees incurred before termination; and (e) no refunds will be provided. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through the following process:

Before initiating formal proceedings, you agree to attempt to resolve any dispute directly with us by contacting info@selyne.app with a detailed description of the issue.

Step 2: Mediation (Optional)

If direct resolution fails, either party may request mediation through a recognized mediation service in Greece or the European Union.

Step 3: Court Proceedings

If mediation is unsuccessful or not pursued, disputes shall be resolved by the competent courts of Athens, Greece, in accordance with Greek law and applicable EU regulations.

15. Collective Actions & Consumer Rights

EU consumers retain all rights available under applicable consumer protection legislation, including the right to participate in collective actions where permitted by EU and Greek law. Nothing in these Terms shall be construed to limit any mandatory consumer rights under EU law.

We reserve the right to modify these Terms at any time at our sole discretion. We will notify users of material changes through the Service, email, or by posting a notice on our website. Changes will be effective immediately upon posting unless otherwise specified. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Greece and applicable European Union regulations, without regard to conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Selyne agree to submit to the jurisdiction of the competent courts of Athens, Greece. EU consumers may also access dispute resolution through their local consumer protection authorities where applicable.

18. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by our authorized representative.
